Temporary status — The bridge

H-1B — Specialty Occupation

The visa most people have heard of — and the only one in this catalogue where preparation does not decide the outcome.

What makes an occupation a specialty occupation

The role has to require the theoretical and practical application of a body of highly specialized knowledge, and a bachelor's degree or higher in a specific speciality has to be the normal minimum for entry into it. The second half is where petitions fail: a job that accepts any degree, or a degree in several unrelated fields, is evidence that no specific speciality is required.

The degree has to belong to the role, not only to the person. A brilliant self-taught engineer in a job that normally requires a computer science degree is a harder petition than the credentials suggest, and the analysis runs through the position before it runs through the candidate.

The part that no amount of preparation fixes

Most H-1B petitions are subject to an annual numerical cap, and reaching the petition stage requires being selected in a registration process first. Selection is not a merits test. A perfect record and a weak one have the same odds.

We say this plainly because it is the honest difference between this category and the rest of the catalogue. In an EB-1A or an O-1, the quality of the evidence changes the outcome. In the H-1B, preparation changes whether a selected registration survives adjudication — it does nothing about getting selected.

Cap-exempt employers exist: certain universities, affiliated non-profits and research organizations. If your employer is one of them, the lottery is not part of your path at all, and the calculation changes completely.

Where the fee litigation stands

A presidential proclamation signed on 19 September 2025 conditioned new H-1B petitions on an additional payment of US$ 100,000, effective for petitions filed after 12:01 a.m. eastern time on 21 September 2025.

That requirement is not being enforced today. On 8 June 2026 the U.S. District Court for the District of Massachusetts vacated the agency guidance implementing it, and on 24 July 2026 the First Circuit denied the government's motion to stay that order pending appeal. DHS has said it will comply while it considers next steps.

Separately, DHS has proposed a filing fee of US$ 103,265 for cap-subject petitions, in addition to all other fees. A proposal is not a rule, and this one is not in force.

This is the only page in this catalogue where the law is actively moving. Checked against USCIS on 26 October 2026; confirm the state of play before relying on any of it.

Common questions

Questions people actually ask

Can I apply for an H-1B myself?

No. The petitioner is an employer, and there is no self-petition route in this category. This is the structural reason people with strong records look at the O-1A or the EB-1A instead — those do not need anyone else to file.

Do I have to pay US$ 100,000?

Not today. The guidance implementing that payment was vacated by a federal court on 8 June 2026 and the government's request to pause that ruling was denied on 24 July 2026. The position is litigation-dependent and can change; the attorney of record will tell you what applies on the day your petition is filed.

What happens at six years?

The six-year maximum can be extended in defined circumstances tied to a pending permanent process. Whether you qualify depends on filing dates and priority dates in your specific case, and it is one of the reasons the permanent route is worth looking at early rather than in year five.
