What it is
A denial on a case we prepared means the work comes back to us. Meritus rebuilds the evidence record, addresses what the decision said was missing, and prepares the petition again — without charging a professional fee for the second preparation.
This applies to the self-petition categories, where the case is built from the person's own record: EB-1A, EB-2 NIW and O-1. Employer-sponsored categories are outside it, because there a denial can come from the employer's side or from the Department of Labor, and guaranteeing someone else's conduct would be dishonest.
What a refile costs you

The filing fee goes to the government and is outside anyone's control. The attorney's fee is theirs, paid directly, and is quoted before the refile begins — Meritus adds no margin to it.

Self-petition categories
EB-1A, EB-2 NIW and O-1. Employer-sponsored petitions and PERM are outside the guarantee.
Nothing withheld
It does not apply where a material fact was withheld, or a document provided to us turns out to be false.
Not for a rule change
It does not cover a denial caused by a change in law or policy that took effect after the petition was filed.
Once, and with your part done
It is available once per case, and requires that you supply the additional evidence the refile needs.
Why not money back
A refund is the easier promise to make and the worse outcome to receive. Someone who was denied does not want the money back; they want the green card, and they have lost months.
Preparing the case again is the only version of this promise that moves you closer to the thing you actually came for. It also costs us more than a refund would, which is the point.

In the engagement, with the same four conditions written on this page. A promise that exists only in marketing is not a promise.
What about an RFE?
An RFE is not a denial. Our work on an RFE response is already included from the start, at no additional professional fee.
What if I no longer qualify by the time of the refile?
Then a refile would not help, and we say so rather than prepare a petition we expect to fail. What changed and what it would take is put in writing.
